Terms of Trade
The following apply to all trade with Gerard Murphy Furniture (GMF):
- Invoice payment timeframes are specified on the invoice, e.g. within seven calendar days of the date of the invoice or immediately
- Payment means payment in full unless otherwise specified or mutually agreed in writing.
- Payment may be made by direct deposit, bank cheque or cash as a matter of course. Payment may be made by EFTPOS or personal cheque by arrangement with GMF.
- Overdue accounts or invoices partially or wholly unpaid by the due date will usually result in one reminder notice. If payment then remains unmade, the matter may be referred to GMF’s debt recovery agent or solicitor. This may result in the cost of collection accruing to the debtor, at the discretion of GMF, at a rate not exceeding the scale of charges of the debt collection agent or solicitor.
- All materials and manufactured goods remain the property of GMF until payment has been received in full.
- Deposits are non-refundable. This applies especially in the case of bespoke or custom commissions where, of their nature, the manufactured objects are specific to the circumstances and/or demands of the customer and may be difficult to retail generally for their actual worth, or retail at all. Deposit amounts, usually 25% of the total price, are calculated to be a reasonable reflection of actual and potential costs to GMF, for example the opportunity cost implicit in scheduling pieces for manufacture.
- Risk attendant upon goods in storage, transit or installation resides with the purchaser.
- GMF will be entitled to charge for and recover from the purchaser or debtor all costs occasioned by the failure of the purchaser or debtor to take delivery of goods or facilitate their installation as and when agreed to. Similarly delay in same.
- Warranty of goods covers workmanship; it excludes misuse, inappropriate location, failure of maintenance or seasonal movement of timber subsequent to purchase. Whilst every effort is made to design and construct pieces to accommodate and or minimise the inevitable expansion and contraction of timber, no responsibility can be taken for the occurrence of such.
- The purchaser will bear the cost of freight, including packaging, forward and return on warranty claims.
- GMF will not necessarily accept the return of goods for credit or any other purpose.
